How is this considered as spawn kill ? Spawn kill means as soon as you spawn, you get killed by someone due to the opponent not letting you move from there. But here you have got 3 seconds  ( i guess ) to move from the spawn position. Which is quite enough.

You yourself are not moving from that position. Even a newbie when experiences this, will get to understand that he has 3 seconds to run away to avoid spawn kill. This is the reason behind adding spawn protection.
