Spawnkilling is disallowed at the default position of the skin. Spawn-kills made at the spawn position set via /lastpos on or /diepos on are allowed.
In the video, you were 1st being spawned at the sharks place, that is your default spawn position. If he had killed you there while you spawned, than report would have been concidered valid. But, as you are being teleported to your lastpos/diepos within 1 second after you spawn, which is not the default spawn pos and spawn killing at positions of /diepos or /lastpos on is allowed.
